Familiar Mediation
Mediation is na
alternative mean of dispute resolution, carried out by public or
private entities, through which two or more disputing parties
voluntarily seek to reach an agreement with the assistance of a
mediator (Law No. 29/2013 of 19 April).
Under
Order No. 18778/2007, of August 22, DR # 161, Series II, family
mediation can have as an object the following matters:
Regulation, change
and failure of the exercise regime of parental responsibilities;
Divorce and separation of people and goods;
Conversion of the
separation of people and goods in divorce;
Reconciliation of
separated spouses;
Assignment and
change of alimony, provisional or definitive;
Deprivation of the
right to use the surname of the other spouse;
Authorization to
use the surname of the former spouse or family dwelling house.
Other
family issues, such as those of the elderly, sharing between siblings
or any other cause of conflicts within families, may also be subject
to mediation.
Family
mediation can develop pre-court or during court proceedings, at the
request of the parties or direction of the judge.
The
family mediation process has two phases: the pre-mediation in which
the subject to be treated is set as well as the mode of treatment,
and mediation, when the the development of a solution, with the
participation of both parts, takes place.
Family
