The Wage
Guarantee Fund is an autonomous fund that ensures the payment of
labor credits to workers on behalf of employers who are insolvent or
in difficulties, in accordance with Article 336 of the Labour Code
and Article 316 the 326 of Law # 35/2004 of 29 July.
Requirements:
- The employee
must have an employment contract or subordinate employment
relationship;
- The employer
has to be declared legally insolvent or in a difficult economic
situation (Extrajudicial Conciliation Procedure (PEC) or
Extrajudicial Business Recovery System (SIREVE) at the Institute of
Support to Small and Medium Enterprises and Investment (IAPMEI)) ;
- Credits must be
emerging from employment contract or their violation or termination
(wages, holyday pay, Christmas or food board, compensation for
termination of the employment contract or non-compliance with its
conditions, productivity bonuses, training hours; interest);
- Credits covered
are those that have been earned in the six months preceding the date
of insolvency proceedings or the application to the SGP or SIREVE;
- The application
must be submitted up to three months before the prescription of
credit (according to the circumstances, the limitation period can be
one year or twenty years).
Note that the
Wage Guarantee Fund makes this payment at once by bank transfer or
letter-check with the overall limit of eighteen times the national
minimum wage and the monthly limit of three times the minimum wage in
respect to credits with monthly nature.
